Terms of Service

1. The service
thecallcenter.ai provides an AI-powered receptionist that answers phone calls for your business, books appointments, captures messages, and syncs with the tools you connect. By creating an account you agree to these terms on behalf of your business.
2. Your account
You must provide accurate information when signing up and keep your account credentials secure. You are responsible for all activity under your account, including actions taken by team members you invite.
3. Free trial and billing
New accounts include a free trial lasting 14 days or 50 minutes of answered calls, whichever comes first, with no card required. When either limit is reached the receptionist stops answering until a plan is selected. After the trial, plans are billed monthly at flat rates through our payment provider (Stripe). Calls identified as spam are not billed against your plan minutes.
You may cancel at any time from the billing page; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law.
4. Acceptable use
You may not use the service for unlawful purposes, including robocalling, telemarketing in violation of applicable law, harassment, impersonation, or fraud. You may not attempt to disrupt the service, probe its infrastructure, or resell it without our written consent.
5. Call recording and compliance
The service may record and transcribe calls so you can review conversations and receive summaries. You are responsible for complying with laws that apply to your business, including call-recording consent laws, industry regulations, and rules governing how you handle your callers' information.
6. Your content
You retain ownership of the content you provide (business information, knowledge base, call data). You grant us the limited rights needed to operate the service — for example, to process your business information so your AI receptionist can answer questions accurately.
7. AI-generated responses
Your receptionist generates responses automatically based on the information you provide. While we work to make it accurate, AI output may occasionally be incorrect. You are responsible for reviewing your receptionist's configuration and the information it shares with callers.
8. Availability and changes
We aim for high availability but do not guarantee uninterrupted service. We may modify or discontinue features with reasonable notice where practical.
9. Disclaimer and limitation of liability
The service is provided “as is” without warranties of any kind, express or implied. To the maximum extent permitted by law, our total liability arising out of or relating to the service is limited to the amounts you paid us in the twelve months before the claim arose. We are not liable for indirect, incidental, or consequential damages, including lost profits or missed business opportunities from unanswered or mishandled calls.
10. Termination
You may close your account at any time. We may suspend or terminate accounts that violate these terms, with notice where practical. Upon termination, your right to use the service ends and we will handle your data as described in our Privacy Policy.
11. Governing law
These terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Texas.
